         Defense Verdict in Construction Litigation

Frank Daily and Ashlee Smith tried a construction case in the Circuit Court of Maryland for Prince George's County and obtained a defense verdict. In that case, the Plaintiff alleged that he had sustained extensive injuries as a result of an accident on a construction site. He alleged that he had been struck by a pipe that had been caused to break as a result of the alleged negligence of a backhoe operator. Our firm defended the backhoe operator and his company.

The case was tried to verdict and the jury returned a defense verdict on behalf of both of our clients.



         Defense Verdict in Pedestrian Knock Down Case

In March of 2009, Frank Daily tried a pedestrian knock down case in the Circuit Court of Maryland for Baltimore City and received a defense verdict. In that case, the Plaintiff was a pedestrian who was crossing a major thoroughfare in Baltimore City. She was struck by two vehicles, the second of which was the vehicle operated by our client. The case presented some dangerous issues because there was limited insurance coverage available to both drivers.

The case was tried to jury in the Circuit Court and the jury found that our client was not negligent. Although the jury found that the Co-Defendant operator was negligent, they found that the Plaintiff was contributorily negligent, so the Plaintiff received no recovery.



         Defense Verdict

In April 2009, a Baltimore City jury returned a defense verdict in favor of Kim Gordon's client and against the co-Defendant driver and his employer for $172,468.28. The co-Defendant alleged that the insured attempted to pass to the left of his vehicle as the co-Defendant was making a left turn. The insured contended that the co-Defendant was making a left turn from the right lane as the insured was properly traveling in the left lane. The impact between the two vehicles caused the insured vehicle to jump the curb and strike the Plaintiff, who was a pedestrian on the sidewalk. The Plaintiff sustained serious injuries that resulted in surgery as well as a skin graft to her lower extremity. The specials presented included medical bills of $22,468.28, past lost wages of $3,144.12, and future lost wages of $582,400.



         Favorable Verdict

Kim Gordon obtained a very favorable verdict in a claim filed against her client, Thomas Amereihn, and the Plaintiff's UIM carrier, State Farm, in the Circuit Court of Maryland for Baltimore County. Liability was admitted and the Plaintiff was previously offered the insured's policy limits of $20,000 as well as an additional $15,000 from the UI carrier. The causation of the Plaintiff's alleged cervical and lumbar injuries was at issue based on the Plaintiff's prior medical history. The Plaintiff introduced specials including medical bills of $33,948.39, future medicals of approximately $120,000 for cervical and lumbar surgery, and past lost wages of $7,928.00. The jury's award of $3,800 represented past medical expenses of $2,073.39, past lost wages of $150.00, and non-economic damages of $1,576.61.
